1. Acceptance of Terms

By requesting, booking, or using any delivery or courier service provided by Day 1 Courier Service LLC ("Company," "we," "our," or "us"), you ("Client," "Customer," or "you") agree to be bound by these Terms and Conditions in their entirety. If you do not agree, do not use our services.

These terms apply to all forms of service engagement including online quote requests, phone orders, email correspondence, and recurring contracts.

2. Services Provided

Day 1 Courier Service provides same-day delivery, rush/on-demand pickup, medical courier, scheduled routes, business/corporate delivery, and package & freight services throughout New Jersey, New York, Pennsylvania, and surrounding areas.

We reserve the right to refuse any shipment or service request at our sole discretion, without obligation to provide a reason.

3. Prohibited Shipments

⚠️ IMPORTANT: Tendering a prohibited item for shipment is a violation of these Terms and may constitute a federal or state crime. The Client assumes full legal and financial liability for any prohibited items.

The Client is solely responsible for:

The Client shall be fully and exclusively liable for any fines, penalties, forfeitures, legal fees, court costs, damages, and all other costs incurred by Day 1 Courier Service arising from the transport of prohibited, misdeclared, or illegal items. This liability survives termination of the service relationship.

The Client agrees to indemnify, defend, and hold harmless Day 1 Courier Service, its owners, employees, agents, and contractors from and against any and all claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to the Client's violation of these Terms, including the tender of prohibited items.

5. Limitation of Liability

Day 1 Courier Service's total liability for any claim arising from a single shipment shall not exceed the lesser of: (a) the declared value of the shipment; or (b) $100.00, unless the Client has purchased additional declared value coverage in writing prior to pickup.

6. Payment Terms

All quoted prices are estimates. Final pricing is based on actual route, package specifications, and service type. Payment is due upon receipt of invoice unless a net-term agreement has been established in writing.

Accounts more than 30 days past due may be subject to a 1.5% monthly late fee. The Company reserves the right to withhold services for past-due accounts.

7. Damaged or Lost Shipments

Claims for loss or damage must be reported within 24 hours of delivery (or scheduled delivery date). Claims not reported within this window may be denied. The Company will investigate all claims in good faith and respond within 10 business days.

8. Service Area & Refusal

We primarily serve New Jersey, New York, and Pennsylvania. Service to other areas is available by arrangement. We reserve the right to refuse service to any Client or location at our sole discretion, including but not limited to locations deemed unsafe for our drivers.

9. Confidentiality

We treat all Client information and shipment details as confidential. We will not disclose such information to third parties except as required by law, court order, or to complete the delivery (e.g., sharing recipient information with our drivers).

10. Compliance with Law

Both parties agree to comply with all applicable federal, state, and local laws and regulations. Day 1 Courier Service cooperates fully with law enforcement. We will report suspected illegal activity and are required by law to assist in investigations involving our services.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Updated terms will be posted at day1courierservice.com/terms.html. Continued use of our services following any update constitutes acceptance of the revised Terms.

12. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the State of New Jersey, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration in Middlesex County, New Jersey, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
